1. Introduction
Welcome to Swipefy! These Terms of Service ("Terms") govern your use of Swipefy, a mobile application provided by Swipefy B.V., a company registered in the Netherlands under Chamber of Commerce number 94623406, with its registered office at Bolwerksepoort 55, 2152EX, Nieuw Vennep.
By accessing or using Swipefy, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our application.
2. Eligibility
Swipefy is intended for users aged 12 and older. If you are under 18, you must have permission from your parent or guardian to use the app. By using the app, you represent that you have the legal capacity to enter into these Terms in your jurisdiction.
3. Account Registration and Management
To use Swipefy, you must create an account by signing in with your Apple ID and connecting Apple Music or by logging in with your Spotify account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You may delete your account at any time through the app settings. Upon account deletion, your data will be handled according to our Privacy Policy.
4. User Content
You may upload content such as profile pictures and playlist cover images ("User Content") to Swipefy. By uploading User Content, you grant Swipefy a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, and distribute your content in connection with the operation of the app.
You are solely responsible for the content you upload and agree not to upload any content that is unlawful, harmful, or otherwise violates these Terms, any third-party rights, or applicable laws.
5. Messaging
Swipefy allows basic messaging between users. You agree to use this feature responsibly and not to send any messages that are abusive, threatening, defamatory, or otherwise inappropriate.
6. Freemium Model and Subscriptions
Swipefy operates on a freemium model. Free users will see advertisements, which may include Google Ads and custom music advertisements. Swipefy Pro, our premium version, offers enhanced features such as a more advanced recommendation algorithm and increased playlist capacity.
You can access Swipefy Pro through a lifetime purchase, subscription, or by winning a giveaway. Purchases made through the mobile app are processed by Apple and Google, and their respective refund policies apply. Purchases made on the web are processed by Stripe, and we offer a 14-day money-back guarantee if you have not used any Pro features.
7. Third-Party Services
Swipefy integrates with several third-party services, including but not limited to:
- Firebase Core
- Firebase Analytics
- Firebase Remote Config
- Firebase Messaging
- Firebase Crashlytics
- Stripe (Privacy Policy)
- Purchasely (Privacy Policy)
These services may have their own terms and privacy policies, which you agree to by using Swipefy. We ensure that all third-party services comply with relevant data protection laws.
8. Data Sharing and Insights
Currently, Swipefy does not share user data with third parties. However, we may provide anonymized insights into user data and trends to third parties in the future. These insights will not include any personally identifiable information and will comply with GDPR, CCPA, and other applicable privacy laws.
9. Termination of Service
Swipefy reserves the right to ban any user from the platform and remove their access at our sole discretion. This may include cases where a user violates these Terms, engages in abusive behavior, or otherwise acts in a manner detrimental to the community. We will notify the user via email or in-app notification if such action is taken.
10. Data Collection and Storage
Swipefy collects and processes various types of data, including but not limited to:
- Basic Spotify/Apple Music account information
- User-generated data, such as profile information, swipe data, and playlist information
Your data is stored in secure data centers located in Germany and managed in compliance with GDPR and other relevant data protection regulations. You may request a copy of your data or its deletion by contacting our Data Protection Officer at [email protected].
11. Content Moderation
We take content moderation seriously and use both automated systems and manual reporting to detect and address inappropriate content. This includes compliance with the Apple App Store and Google Play Store guidelines to ensure the safety and security of our users.
12. Updates to the Terms
Swipefy may update these Terms from time to time. When we do, we will notify you by email or through the app. Your continued use of the app following any updates signifies your acceptance of the revised Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Netherlands. Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the Netherlands. For users in the United States, disputes may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
